Terms and conditions

1. Agreement

These terms govern services purchased from AXF Creative (“AXF”, “we”, “us”) by you or the business you represent (“client”, “you”). Placing an order through this website means you accept these terms. By ordering you confirm you are authorized to enter this agreement on behalf of the business named in the order.

2. What you are buying

One-time website build: a custom-designed website of the page count selected at checkout, including responsive layout, on-page SEO fundamentals, contact form or click-to-call setup, and one round of revisions on the initial design. The build fee starts at $1,000 and covers up to ten pages; each additional page is $100.

Monthly hosting and care ($50/month): hosting, SSL, software and security updates, uptime monitoring, backups, and minor content edits requested by email (text and image swaps, hours, contact details). Hosting begins 30 days after purchase and continues monthly until cancelled.

30 SEO-rich blog posts ($500, optional): thirty blog articles drafted for your site, published on a schedule agreed during onboarding.

Google Ads management — Starter ($300/month, optional): setup and ongoing management of one Google Ads campaign with a monthly performance report. Advertising spend is paid by you directly to Google and is not included in this fee.

3. What is not included

Unless stated in writing, the following are not included: advertising spend, domain registration or renewal fees, paid stock photography, third-party software or plugin licenses, copywriting beyond the pages ordered, e-commerce or booking platform fees, print or brand identity design, and integrations with systems we have not agreed to in writing.

Redesigns, additional page templates, or new feature requests after the initial design approval are quoted separately.

4. Timeline and your cooperation

Your website is published within 15–30 days of your onboarding call, provided you supply required content, brand assets, account access, and approvals promptly. Timelines pause while we are waiting on you.

We aim to respond to feedback within two business days. If we receive no response to a request for content or approval for 30 consecutive days, the project may be paused and reactivated at our discretion; fees already paid are not refunded for delays caused by lack of response.

5. Payment

One-time build fees, additional page fees, and blog package fees are charged in full at checkout. They are non-refundable once work has begun, because work starts immediately after your order.

Your monthly subscription (hosting and, if selected, Google Ads management) starts automatically 30 days after purchase using the payment method provided at checkout, and recurs monthly on that date. Prices may change with 30 days’ written notice; changes never apply retroactively.

If a payment fails, we may retry the charge and may suspend hosting, ads management, and support until the balance is settled. Accounts more than 30 days past due may have their site taken offline.

6. Cancellation

You may cancel monthly hosting or Google Ads management at any time with 30 days’ written notice by emailing hello@axfcreative.com from the email address on the account. Service continues, and is billed, through the end of the 30-day notice period. Partial months are not refunded.

One-time build, additional page, and blog fees are non-refundable. Cancelling monthly service does not entitle you to a refund of any one-time fee already paid.

We may cancel or suspend service with 30 days’ notice, or immediately for non-payment, abusive conduct, or unlawful use of the site.

7. Website ownership and transfer

You own your content: text, images, logos, and any material you provide, plus the finished page content produced for you. AXF retains ownership of its underlying templates, reusable components, code libraries, and internal tooling.

Your site is built and maintained on AXF infrastructure. If you want it moved to hosting you control, a one-time transfer fee of $500 applies. Once that fee is paid and your account is settled, we hand over the site files, assets, and content so your new provider can take it live.

If you cancel and do not request a transfer, the live site is taken offline at the end of the notice period. We are not obligated to retain your files more than 30 days after service ends.

8. Your responsibilities

You confirm that all content you supply is accurate and that you hold the rights to use it, and you agree not to publish unlawful, infringing, or misleading material through the site.

You are responsible for keeping your domain registration active and for the accuracy of business information, pricing, hours, and claims displayed on your site.

9. No guarantee of results

SEO, AEO, and advertising results depend on factors outside our control, including search engine and AI platform algorithms, competitor activity, and market conditions. We do not guarantee rankings, traffic volume, lead volume, conversion rates, or revenue. Any figures discussed are estimates, not promises.

10. Uptime and third-party services

We work to keep your site available but do not guarantee uninterrupted service. Downtime may occur from hosting providers, domain registrars, DNS, payment processors, Google, or other third parties, or during scheduled maintenance. We are not liable for outages, data loss, or policy changes caused by third-party providers.

11. Limitation of liability

Services are provided “as is”, without warranties beyond those stated here. To the maximum extent permitted by law, AXF is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

Our total liability for any claim arising from these services is limited to the amount you paid us in the three months before the claim arose.

12. Confidentiality and privacy

Each party will keep the other’s non-public business information confidential. We collect and use your contact and order information to deliver these services and communicate with you about your account, and we do not sell your information.

13. Portfolio use

Unless you ask us in writing not to, we may display your completed website, and reference your business name, as an example of our work in our portfolio and marketing materials.

14. Changes to these terms

We may update these terms. Material changes affecting active clients take effect 30 days after we post them or notify you by email. Continuing to use the services after that date means you accept the updated terms.

15. Governing law and disputes

These terms are governed by the laws of the United States and the state in which AXF Creative operates, without regard to conflict-of-law rules. The parties agree to attempt to resolve any dispute in good faith by direct discussion before pursuing formal proceedings, and to bring any proceedings in the courts of that state.
